Fire Safety Order Amendments Caused by Section 156 of the Building Safety Act 2022

Applies to All Premises Including Those with Two or More Dwellings

 

Article 9 ... All Fire Risk Assessments must be recorded

Article 11 ... An Action Plan must be recorded

Article 22 (new)A1 ... Where any other responsible person shares or has duties regarding the premises ascertain who is responsible to what parts. Inform other RPs of which parts they consider themselves responsible for. Record that information.

Article 22 A5 ... The RP must keep records of all "Relevant Fire Information"... Article 50 ... The Government to provide applicable fire safety guidance which must be followed. Fire risk assessor to provide that information via the Fire Risk Assessor

 

Article 21A ... The RP must give residents of domestic premises relevant information about the relevant fire safety matters.

 

relevant Fire Safety Matters are:

1. The risks to residents of the domestic premises identified by the fire risk assessment. Article 9

2. The preventative and protective measures. Article 11

3. The name of the responsible person and a UK address at which the RP or someone acting on their hehalf will accept notices and documents.

4. The identity of any person nominated by the RP to assist them with making or reviewing a fire risk assessment under Article 9 e.g Fire Risk Assessor

5. The identity of any persons nominated by the RP under Article 13(3)(b) e.g Fire Alarm Engineer.

6. Any risks of which the RP has been informed under Article 22(1)(c)

These MUST be recorded in the Fire Risk Assessment.

 

All premises with 2 or more dwellings and at least 7 storeys / 18 metres.

 

Article 22B (new) Co-operation with Accountable Persons.

The RP must take such steps as are reasonably practicable to ascertain whether there are one or more other persons with duties,  Accountable Persons, in relation to the premises.

The RP must co-operate with each Accountable Person  in order that the Accountable Person can carry out their duties underb thev Building Safety Act 2022

The identity of the Accountable Person must be passed on to any new Responsible Person.
